Think about the following questions in conjunction with the readings

Are you satisfied with how the common law separates degrees of intentional killings?  If not, what should the dividing line be?  What makes a particular intentional killing more or less culpable?  How do you capture that as a legal standard?  

How do you prove intent?  Deliberation?  What kind of facts would you look for? 

Why does the law recognize a "defense" of provocation?  How should it be interpreted?
