Class 28:  Defenses to Intentional Killings

Prepare:

Read Dressler 221-239, 246[C]-249, 255-257, 259-268, 273-281

Do the CALI lessons on self-defense, defense of others and retreat

Think about the following questions in conjunction with the readings:

Under what circumstances should a defendant who intends to kill not be subjected to punishment for murder?  Do you think the law of defenses and voluntary manslaughter adequately answers this question?  What kinds of facts should suffice for self-defense?  Defense of others? a provocation defense?  Why?

How is the provocation defense different from these other defenses.  What other defense that we've seen is most comparable to provocation and why?
