If

Romer
v. Evans and Patrick v. Le Fevre indicate that Davis v. Beason
is
either being overruled or was previously overruled. What is interesting
is that Patrick v. Le Fevre (which was a Second Circuit case) precedes
Romer
(a
Supreme Court case) by 12 years in announcing that Davis v. Beason,
or at least a part of it, has been overruled.
